  1. Introduction
    Welcome to the terms and conditions for CIMs Marketing Consultants Directory. These terms and conditions explain your rights and obligations, and are supplementary to the disclaimer and privacy statement which governs usage of the CIM website.

    Please read these terms and conditions carefully, as your continued use of this directory indicate that you accept them. Please contact us with any enquiries and comments.

    1. Definitions
      The Marketing Consultants Directory is operated by The Chartered Institute of Marketing and is part of a larger range of products and services that we offer. The terms "CIM", "we", "us", or "our", refer to the operator of the website you're in.

    2. Variation of terms and conditions
      We reserve the right to change these terms and conditions from time to time, and the amended terms will be posted on our website.

  2. Terms of inclusion
    1. To participate you must be a current CIM voting member and be either: (ACIM, MCIM, and FCIM)
    2. The Consultants Directory is not accredited therefore CIM are not responsible for the actions or work undertaken by the consultants listed
    3. By agreeing to be a CIM member and being listed in the CIM Marketing Consultants Directory you are agreeing that you are a dedicated marketing professional and will abide by the CIM code of professional standards
    4. Editorial Content is subject to copyright and is the property of The Chartered Institute of Marketing

    Legal notice: The editorial content of the directory provides a summary of current and emerging laws that marketers may face in dealing with consultants/clients. It is not intended as legal advice or counsel, and is not represented as such by the author or publisher. It is advised that legal counsel is sought to ensure compliance with legislation.

  3. Materials in site and software rights
    1. All copyrights, trademarks, patents, design rights, and other intellectual property rights relating to our website (including, but not limited to, the underlying software, the design, graphics, layout, feel, and structure of our website) will be and remain the sole property of The Chartered Institute of Marketing and our licensors.

  4. Our liability

    3. Except as set out in clause 4.4, we shall not be liable to you in connection with this Terms and Conditions for losses that are not a reasonably foreseeable consequence of our actions. If you are using our websites for commercial purposes, we shall not be liable for any loss of profits, loss of contracts, loss or corruption of data, or other economic loss arising in connection with this Agreement
    4. These terms and conditions do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, or for any matter which it would be illegal for CIM to attempt to exclude its liability and do not affect your statutory rights
    5. Our websites may contain links to other sites, which are outside our control and are not covered by these terms and conditions

    If you access other sites using the links provided, we cannot be responsible for the content of those sites or for the way in which they deal with you or use any information they may acquire about you.

  5. Your liability
    1. You shall compensate us in full if we incur any losses or if any claims or legal proceedings are brought or threatened against us by any other person arising from your use of our website.
    2. Members will be allowed to make up to four amendments to their directory entry within one calendar year, free of charge. Subsequent amendments will be made subject to a nominal administration fee.

  6. Acceptance of these terms
    This Agreement is deemed to be made in England and is subject to English law and the exclusive jurisdiction of the English courts.

  7. Matters beyond reasonable control
    Neither party is liable for any breach of this Agreement that is caused by a matter beyond its reasonable control, including acts of God, fire, lightning, explosion, war, flood, industrial disputes, sabotage, extremely severe weather, or acts of local or central Government or other competent authorities.

    Nothing on this website is intended to be nor should be construed as an offer to enter into a contractual relationship.

  8. Advertisers
    Termination clause: CIM reserve the right to exclude any participant who is in breach of the terms and conditions or the code of professional standards.

    Logo: Persons included in the directory are not permitted to use the CIM logo on materials which may imply endorsement by CIM.
